These Terms and Conditions apply to the Tribe Padel & Wellness website and to purchases, memberships, bookings, programs and services supplied by TRIBE PADEL WELLNESS PTY. LTD. ABN 366 7154 6660, trading as Tribe Padel & Wellness (“Tribe”, “we”, “us” or “our”).
By making a purchase, creating an account or booking or participating in a Tribe service, you agree to these terms and any additional terms clearly disclosed for that particular membership, booking, event, program or promotion.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
1. Prices and payments
Unless stated otherwise:
- all prices are in Australian dollars;
- prices include GST where applicable;
- the price and inclusions displayed at the time of purchase apply to that purchase;
- payment must be made using an accepted payment method; and
- purchases are subject to successful payment authorisation.
Payments may be processed through Square, Playtomic or another payment provider. The provider may apply its own terms, privacy practices or transaction processes.
If a payment is declined, reversed or overdue, we may suspend the relevant booking, membership or service until payment is received.
We may correct genuine pricing or description errors. If an error affects a completed purchase, we will contact the customer and offer an appropriate correction, alternative or refund.
2. Online purchases and confirmations
A purchase is confirmed when the customer receives an order, payment or booking confirmation.
Customers are responsible for checking the confirmation and promptly advising us of any errors. Availability, inclusions, commencement dates and special conditions stated on the product page, checkout page or confirmation form part of the purchase agreement.
3. Pre-opening membership purchases
Where a membership is sold before the relevant Tribe venue officially opens:
- the advertised pre-opening payment, commencement arrangements and membership benefits will apply;
- access provided during a complimentary testing or preview period does not bring forward the paid membership commencement date unless expressly agreed;
- ongoing membership billing will not begin before the communicated membership commencement date;
- if the anticipated opening date changes, Tribe will communicate the revised arrangements as soon as reasonably practicable; and
- if Tribe cannot provide the purchased membership within a reasonable time, the member may request an appropriate remedy, which may include cancellation and a refund of amounts paid for services not supplied.
Any founding-member price, benefit or other promotional entitlement is subject to the eligibility, availability and conditions disclosed when the membership was purchased.
4. Membership terms
The price, billing frequency, initial commitment, inclusions and benefits of each membership are those displayed or supplied when the member joins.
Unless the relevant membership offer states otherwise:
- memberships are personal and cannot be transferred or shared;
- members must maintain accurate account and payment information;
- ongoing fees are charged in advance at the disclosed billing frequency;
- promotional or complimentary access has no cash value;
- unused benefits, credits or inclusions do not roll over unless expressly stated;
- membership discounts cannot be combined with other offers unless stated; and
- membership benefits remain subject to facility capacity, availability, operating hours and applicable booking rules.
A member may request cancellation by emailing melbourne@tribe.club or using an available cancellation function in the relevant membership platform.
Where a membership has a minimum commitment period, cancellation will take effect no earlier than the end of that period unless Australian Consumer Law or another applicable right permits earlier cancellation. After any minimum commitment has been completed, cancellation will take effect at the end of the current paid billing period, provided the request is received before the next scheduled payment.
Fees already paid are not refundable solely because of non-attendance, lack of use or change of mind, except where required by law or expressly stated in the applicable offer.
We may suspend or terminate a membership for serious or repeated breaches of these terms, unsafe or abusive behaviour, payment default, fraud or misuse. Where reasonable, we will first give the member notice and an opportunity to remedy the issue.
5. Court and program bookings
Bookings are subject to availability, venue opening hours and the rules displayed through the relevant booking platform.
Unless different terms are displayed for a particular booking:
- cancellations or changes made at least six hours before the scheduled start time may be eligible for a refund or booking credit;
- cancellations made less than six hours before the scheduled start time, and failures to attend, are not eligible for a refund or credit;
- late arrival does not extend the booking;
- customers must leave the court or activity area at the end of their allocated time; and
- the person making a booking is responsible for ensuring their guests understand and comply with applicable venue rules.
Where a booking is made through Playtomic or another platform, the customer may also be subject to that platform’s terms, cancellation process and payment arrangements.
6. Events, coaching and other programs
Event, competition, coaching, social-play and program registrations may have specific cancellation or transfer conditions displayed when booking. Those specific conditions take precedence where they differ from the general booking rules above.
If a minimum number of participants is required, we may reschedule or cancel a session that does not meet that number. Customers affected by a Tribe cancellation will be offered a transfer, credit or refund as appropriate.
7. Tribe cancellations and service interruptions
We may cancel, relocate, shorten or reschedule a booking, program or event because of:
- safety concerns;
- facility faults or damage;
- coach or staff unavailability;
- severe weather where relevant;
- government directions;
- circumstances beyond our reasonable control; or
- insufficient participant numbers.
Where Tribe cancels a paid service and does not provide a reasonable alternative, the customer will receive a refund or credit for the affected service, subject to applicable law.
8. Refunds and Australian Consumer Law
Our services and products come with guarantees that cannot be excluded under the Australian Consumer Law.
Customers may be entitled to a refund, replacement, repeat service, cancellation or other remedy where a product or service fails to meet an applicable consumer guarantee. The available remedy depends on the circumstances and whether the failure is major or minor.
We do not provide refunds solely for change of mind unless a particular offer expressly states otherwise.
To request a refund or other remedy, email melbourne@tribe.club with:
- your name and contact details;
- the booking, order or transaction details;
- the reason for the request; and
- any relevant supporting information.
Approved refunds will ordinarily be returned to the original payment method. Processing times may depend on the payment provider and financial institution.
9. Retail products
Retail products must be fit for their intended purpose, match their description and meet other applicable consumer guarantees.
For a faulty or incorrectly supplied product, please contact Tribe and provide proof of purchase. We may need to inspect the product before confirming the appropriate remedy.
Unless expressly offered by Tribe, refunds are not provided for change of mind. This does not affect rights available under the Australian Consumer Law.
10. Participation, safety and conduct
Padel, fitness, wellness and related physical activities involve inherent risks. Participants must:
- follow staff instructions, safety signage and venue rules;
- use facilities and equipment responsibly;
- behave respectfully towards staff, members and guests;
- disclose relevant injuries, medical conditions or safety concerns where reasonably necessary;
- stop participating and seek assistance if they feel unwell or unsafe;
- supervise children in their care except during an expressly supervised program; and
- not participate while affected by alcohol, drugs or any condition that makes participation unsafe.
Participants are responsible for deciding whether an activity is suitable for them and should obtain medical advice where appropriate.
To the extent permitted by law, Tribe is not responsible for loss or injury caused by a participant’s failure to follow instructions, misuse of facilities, deliberate or reckless conduct, or failure to take reasonable care.
Nothing in this section excludes liability that cannot legally be excluded.
11. Wellness and recovery facilities
Customers using sauna, cold-plunge, recovery or similar facilities must follow all displayed rules and staff directions.
People who are pregnant, under medical care, taking relevant medication or living with cardiovascular, circulatory or other health conditions should seek medical advice before using these facilities.
Customers must not use wellness facilities if doing so may be unsafe for themselves or others.
12. Children and junior participants
A parent or legal guardian must complete or authorise registrations for participants under 18 where requested.
Parents and guardians are responsible for providing accurate medical, emergency-contact and collection information and advising Tribe of relevant changes.
Children must be supervised except while participating in a formally supervised Tribe program.
13. Guest responsibilities
Members and booking organisers are responsible for ensuring their guests:
- are properly registered where required;
- complete any required waiver or participation acknowledgement;
- comply with venue rules; and
- pay any applicable guest or participation fees.
14. Accounts and third-party platforms
Customers must keep account credentials secure and notify Tribe or the relevant platform if they suspect unauthorised activity.
Tribe is not responsible for the independent operation of third-party websites, applications or payment systems. Use of those services may also be governed by the provider’s own terms and privacy policy.
15. Website content and intellectual property
Website content, branding, graphics, photographs and materials owned by Tribe must not be copied, reproduced or commercially used without permission, except as permitted by law.
We aim to keep website information accurate and current but do not guarantee that all content will always be complete or error-free.
16. Photography and recording
Tribe may photograph or film facilities, events and activities for operational or promotional purposes where appropriate.
We will seek consent where required, particularly for identifiable promotional images of children. Customers who do not wish to be included should notify staff or the photographer.
Unauthorised commercial photography or recording at Tribe venues is not permitted.
17. Changes to services and terms
We may make reasonable changes to operating hours, timetables, booking rules, membership benefits or these terms.
Where a change materially affects an ongoing paid membership, we will provide reasonable notice and any rights required by law. Changes will not remove rights that have already accrued.
18. Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the jurisdiction of the courts and tribunals of Victoria and the Commonwealth of Australia.
